Excerpt: The book Transgender Rights includes a chapter written by GLAD attorneys on “Pursuing Protection for Transgender People through Diversity Laws,” meaning that transgenders can and will also use “sexual orientation” laws to get their way. They have also used the argument that since “gender identity disorder” is a disability, individuals can claim protection under disability law. (They don’t like to use the latter unless absolutely necessary, since it admits a disability or disorder! But that legal argument was used by GLAD in the Brockton, Mass. transgender student case. Do anything that works…) If Massachusetts passes H1722, things would be much easier. Besides the statutes specifically targeted by H1722, what other issues would be affected by adding “gender identity or expression” protection to our laws?
